These Terms and Conditions (“Terms”) govern your access to and use of this website, any related subdomains, and any associated services, features, enquiry forms, secure payment pages, and the YATIRIM UK LIMITED real estate mobile application (together, the “Platform”).

By accessing or using the Platform, you confirm that you accept these Terms. If you do not agree, you must not use the Platform.

1. Who we are

The Platform is operated by YATIRIM UK LIMITED (“we”, “us”, “our”).

2. Important regulatory notice (credit broking)

YATIRIM UK LIMITED is applying for authorisation by the Financial Conduct Authority. We act as a Credit Broker, not a Lender.

Any finance-related content on the Platform is provided for general information and initial enquiry purposes only and may be subject to eligibility checks, lender criteria, fees, and formal documentation.

3. Services and scope

The Platform may include information and enquiry routes relating to (without limitation) real estate listings and consultancy, finance facilitation, construction, renovation and decoration, and UK residency-related services.

Unless expressly agreed in writing, nothing on the Platform constitutes:

  • legal advice,

  • regulated financial advice,

  • tax advice, or

  • an offer capable of acceptance without further steps and checks.

4. Eligibility and user responsibilities

You must be legally capable of entering into a binding contract to use the Platform. You agree that:

  • information you submit is accurate and complete,

  • you will keep your details up to date, and

  • you will not impersonate another person or misrepresent your authority.

5. Accounts and security

Some features may require login or account functionality. If you create or access an account, you are responsible for:

  • keeping credentials confidential,

  • all activity carried out under your account, and

  • notifying us promptly if you suspect unauthorised access.

We may suspend or restrict accounts where we reasonably believe there is misuse, fraud risk, security risk, or breach of these Terms.

6. Property listings and information accuracy

Property listings, pricing, availability, floor areas, images, maps, descriptions, yield illustrations and similar content are provided for convenience and may be supplied by third parties (for example, developers, agents, owners, or data providers). You acknowledge that:

  • information may change without notice,

  • images and plans may be indicative only,

  • exchange rates and cost estimates can vary, and

  • you must independently verify details before committing to any transaction.

To the maximum extent permitted by law, we are not responsible for losses arising from reliance on inaccurate, incomplete, or outdated listing content.

7. Enquiries, introductions, and third parties

Where the Platform enables you to submit an enquiry or request a call-back, you authorise us to contact you and to share relevant enquiry details with appropriate third parties strictly for the purpose of progressing your request (for example, developers, agents, solicitors, mortgage lenders, valuers, surveyors, contractors, or service providers), where necessary.

Third-party products and services are governed by those third parties’ terms. We do not control and are not responsible for third-party websites, platforms, or contractual documents.

8. Secure payments (if available)

If the Platform provides a secure payment or payment facilitation function, payment processing may be handled by third-party payment providers. You agree to:

  • provide accurate payer and billing details,

  • comply with any payment provider requirements, and

  • use only payment methods you are authorised to use.

Refunds, chargebacks, and cancellations depend on the underlying agreement for the relevant service or reservation and any applicable consumer law. Where a written service agreement exists, that agreement will prevail on payment and refund terms.

9. Fees and commissions

We may receive fees or commissions from third parties (for example, developers, agents, lenders, or other service providers) for introductions or successful transactions, where lawful and applicable. If a specific engagement includes additional fees payable by you, those will be disclosed in writing before you are asked to commit.

10. Acceptable use

You must not:

  • use the Platform unlawfully or fraudulently,

  • interfere with the Platform’s operation or security,

  • scrape, harvest, or mine data from the Platform without written permission,

  • upload malicious code, or attempt unauthorised access to any system,

  • post or transmit content that is defamatory, obscene, threatening, or infringes rights.

We may remove content, block access, or take other action where we believe acceptable use has been breached.

11. Intellectual property

We and/or our licensors own all intellectual property rights in the Platform and its content, including branding, text, layout, graphics, software, and databases, except where stated otherwise.

You may print or download extracts for personal, non-commercial use only. You must not reproduce, distribute, or exploit the Platform content for commercial purposes without our prior written consent.

12. User content

If you submit content (for example, enquiry text, documents, or messages), you:

  • confirm you have the right to submit it, and

  • grant us a non-exclusive, worldwide, royalty-free licence to use it for the purposes of providing services, responding to your request, compliance, record-keeping, and dispute handling.

13. Privacy and cookies

Your use of the Platform is also governed by our Privacy Policy, which explains how we collect, use, and protect personal data, including where relevant to the mobile application and applicable data protection requirements.

14. Disclaimers

The Platform is provided on an “as is” and “as available” basis. While we aim to keep it accurate and up to date, we do not guarantee that:

  • the Platform will be uninterrupted or error-free,

  • content is complete, accurate, or current, or

  • the Platform is free from viruses or other harmful components.

15. Limitation of liability

Nothing in these Terms excludes or limits liability that cannot be excluded by law (including liability for death or personal injury caused by negligence, or fraud).

Subject to the above, to the maximum extent permitted by law, we will not be liable for:

  • loss of profits, revenue, business, goodwill, or opportunity,

  • indirect or consequential losses,

  • losses arising from third-party acts or omissions,

  • losses arising from reliance on listing information without independent verification, or

  • losses arising from inability to use the Platform.

16. Indemnity

You agree to indemnify and hold us harmless against claims, liabilities, damages, losses, and expenses arising from your breach of these Terms, unlawful use of the Platform, or infringement of any third-party rights.

17. Suspension and termination

We may suspend, restrict, or terminate your access to the Platform at any time if we reasonably believe you have breached these Terms, created a security risk, or used the Platform unlawfully.

Termination does not affect rights and obligations accrued prior to termination.

18. Changes to these Terms

We may update these Terms from time to time by publishing an updated version on the Platform. Your continued use after changes are posted constitutes acceptance of the updated Terms.

19. Governing law and jurisdiction

These Terms are governed by the laws of England and Wales. Subject to any mandatory consumer protections, the courts of England and Wales shall have exclusive jurisdiction over disputes arising out of or in connection with these Terms.
